Court’s refusal to confirm adoption

A civil court (in Romanian: instanța de judecată) makes the judgment either confirming the adoption of a child or refusing it. If the civil court has refused to confirm the adoption, you may appeal the judgment to a higher-level court: the relevant Court of Appeal. The procedure and time-limits for the appeal should be indicated in the lower court’s decision.

Application

In your application to the court, you should:

  • refer to the relevant legal provisions that give you the right to request the confirmation of a child’s adoption
  • explain that you have fulfilled the formal criteria for the submission of a request for a confirmation of adoption, such as the consent to adoption by a child’s biological parents, if required by the law
  • add all relevant documents that substantiate your request, if there are any
